1 Law:: will; last will; last will and testament; holograph will; script; affidavit of scripts; testament – وصيتنامة تمليكي 1. bequest : property (usu personal property other than money) disposed of in a will 2. devise : a will disposing of real property – وصيتنامة خودنوشت a holograph will (holograph – On account of the difficulty with which the forgery of such a document can be accomplished it is held by the Scotch law valid without witnesses. So, a holograph will is a will written in the testator’s own hand – JBS( self-wrtten holographic will (holoohraph – A will or deed written entirely by the testator or grantor with his own hand and not witnessed (attested). State laws (in the US) vary widely with respect to the status of self-written “holographic” wills. Some states categorically refuse to recognize any will not meeting the formal statutory requirements relating to attestation clause, witnesses, etc. Others will recognize a holographic will if all or certain portions are in the handwriting of the testator. And many states that do not recognize holographic wills executed by their own citizens within their borders will nevertheless recognize such wills if valid under other jurisdictions. Under the Uniform Probate Code (as adopted by several states), such will is valid, whether or not witnessed, if the signature and the material provisions are in the handwriting of the testator. HCB وصيتنامة نظامي 1. military testament : In English law, a nuncupative will, that is, one made by word of mouth, by which a soldier may dispose of his goods, pay, and other personal chattels, without the forms and solemnities which the law requires in other cases 2. soldier’s will : similar to a seaman’s will which is informal in nature and may dispose only of the personal property of the testator. A nuncupative will, ie وصيت شفاهي which see under وصيت – آخرين وصيتنامه This is almost unmeaning and out of good taste in Persian, and is all too obviously a verbatim translation from the English last will and testament, last will, which means exactly that same as will and the equivalent of which in Persian is simply وصيتنامه the adjective آخرين being an unnecessary qualifying word in Persian, unless of course there is conclusive evidence that the testator had previously made another testament which he revoked later on, the latter being the one which is now specifically referred to. The Persian equivalent for last will and testament, therefore, being simply وصيتنامه ـ وصيتنامة معتبر or وصيتنامة مصدق English last will and testament being an established term without necessarily implying a previous will that was revoked by the testator. بدون وصيتنامه intestate – بدون وصيتنامه فوت كردن die intestate – برمبناي وصيتنامه and به موجب وصيتنامه testamentary (adj) – تحصيل تصديق صحت وصيتنامه take / taking out probation of a will – فاقد وصيتنامه : بدون وصيتنامه which see above – ضمائم وصيتنامه ـ ضميمة وصيتنامه and متمم يا مكمل وصيتنامه codicil (n), codicillary (adj) – متوفاي با وصيتنامه see under متوفي in the main entry
